Housing and Community Care Team
We provide recognised expertise in housing, human rights and community care cases.
We are committed to promoting the rights of homeless people, tenants and those with limited rights of occupation. We advise and represent clients at all levels from the County Court to the European Court of Human Rights. We are regularly involved in leading cases.
We operate an out-of-hours rota for urgent applications to the Duty Judge, can complete paperwork at short notice and deliver by email. We are happy to discuss cases by telephone prior to formal instruction.
Members of the team publish articles in Legal Action and the Journal of Housing Law, and provide training for specialist organisations such as Shelter and the Housing Law Practitioners Association.
We provide email briefings on the latest developments, in-house training sessions by arrangement, and a free seminar programme throughout the year.
We provide an efficient and friendly clerking service. Our clerks, Ian and Sian, are happy to discuss clients’ requirements and to assist in the selection of appropriate counsel.
Some of the areas of law we cover: Homelessness, Allocation of social housing, The Children Act 1989 duties and powers, The National Assistance Act 1948 duties and powers, The NHS and Community Care Act 1990 duties and powers, Possession claims, Anti-social behaviour, Unlawful eviction, Disrepair, Housing standards, Housing Benefit and Emergency Injunctions.
As part of our service, we regularly deal with cases for homeless individuals and families who may be entitled to be housed immediately under s.188 Housing Act 1996, or under the community care, asylum support or Children Act 1989 provisions.
We operate an out-of-hours rota to enable emergency applications to be made to the Duty Judge in the High Court.
An experienced member of the Housing and Community Care Team will be available to discuss or prepare applications.
