R (TG) v Lambeth [2011] EWCA Civ 526

Instructed by Steel & Shamash, Jamie Presland, successfully appealed Lambeth's refusal to treat TG as a former relevant child where he had been identified by a Youth Offending Team social worker at 16 as a child in need and in urgent need of accommodation. Accommodation then provided by the housing department was held to be provided by Children's Services so that he was an eligible for leaving care services. Now 21, Lambeth are to undertake a fresh pathway plan assessment under the provisions of section 23CA of the Children Act 1989. The Court refused permission to pursue a claim for damages for breach of Article 8.
